Article 1 - Organization

The FIS Freeride World Tour by Peak Performance is organizing a contest (the "Contest") entitled "Rider of The Day by Alpina" offering the chance to win a Alpina watch during the competition period. Participation in the Game is free of charge, and winners will be selected by random draw under the conditions defined below.

The Contest will run on the competition day until 8:00 p.m. (Switzerland time) the same day ("Contest Period"). All entries received after the expiration of the Game Period are excluded and will not be considered by the Organizer.

Article 2 - Participants

2.1 The Contest is free of charge and no purchase is necessary. It is open to all individuals over the age of 14, excluding all employees of the Organizer. Any participant under the age of eighteen must have obtained the prior consent of a parent or legal guardian before entering the Game.

2.2 Participation in the Game implies irrevocable and unconditional acceptance of the terms and conditions of these rules (hereinafter the "Rules").

2.3 Participation in the Game is strictly personal and nominative. A predefined number of prizes will be awarded to one or more designated winners.

2.4 Failure to comply with the conditions of participation set out in the Rules will result in the participant's participation being null and void.

Article 3 - Principle of the Contest / How to enter

To obtain a chance of being drawn for a Prize, each person must during the Contest Period on the competition day until 8:00 p.m. the same day :

Only one entry per e-mail address per day is permitted.

Article 4 - Designation of winners

4.1. The Organizer, in the person of FIS Freeride World Tour by Peak Performance, will designate one or more winner(s): 

either by drawing lots among all the participants who completed the Vote concerned ;

4.2. When the winner is designated by a draw, the draw will take place within 24 hours following the closing of the Vote, with the exception of Fridays and Saturdays, when the draw will take place on the following Monday. 

4.3. The Vote offers the chance to win one prize.

4.4. The Organizer will bear the cost of the prize and the shipping costs.

4.5. The Organizer will not bear any costs related to Customs duties.

Article 5 - Prize

5.1. The prize is an Alpina watch. It will be distributed by drawing lots. The winner will be able to choose the watch based on a pre-selection. 

5.2. The prize for the draw is provided by FIS Freeride World Tour. 

5.3. The Prize may not be taken back by the Organizer, nor exchanged for its cash value or for any other gift. The prize is personal and non-transferable. The winner undertakes not to sell, offer to sell or use the Prize for commercial or promotional purposes.

Article 6 - Delivery and use of prizes

6.1. The Organizer will contact the winners by e-mail or telephone and inform them of their prize and how to access it. No mail or private message will be sent to participants who have not won; only winners will be contacted. Winners must reply within 72 hours of the confirmation email and provide their full contact details or any additional information requested by the Organizer. Without a complete response from the winners within 72 hours of the e-mail being sent, they will forfeit their Prize and will not be entitled to any indemnity, endowment or compensation whatsoever. In this case, the Lot will be reallocated in a new draw.

6.2. Winners must comply with the Rules. If they do not meet the criteria of the Rules, the Prize will not be sent and will be reallocated in a new draw. To this end, participants authorize any verification of their identity, age and contact details. Any false declaration, indication of identity or postal address will result in the immediate cancellation of the acquisition of the Lot by the winner, and the Lot will be reallocated in a new draw. 

6.3. In the event that FIS Freeride World Tour by Peak Performance is unable to deliver the prize to the winners for any reason whatsoever, FIS Freeride World Tour by Peak Performance reserves the right to substitute a prize of equivalent value, to which all participants agree.

Article 7 - Use of participants' personal data

Participants are reminded that, in order to take part in the Game, they must provide certain personal information ****(Cf. https://www.freerideworldtour.com/privacy-policy/) concerning themselves (surname, first name, e-mail address, postal address, etc.). This information is required to determine the winners by drawing lots, and to award, send and use the Prize.

The automated processing of this personal data, complies with the RGPD (General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016). In accordance with this same Law, participants have at all times a right of access to data concerning them and a right to rectify or delete nominative information concerning them, which they may exercise by contacting the organizer at the following address: digital@freerideworldtour.com

During the campaign day supported by a partnering entity, participants may choose to subscribe to the partner's newsletter through an opt-in mechanism. The provided participant information, including surname, first name, email address, country will be shared with the partnering brand. Acceptance of the FWT partners' opt-in implies participants' automatic agreement to the Partner's Privacy Policy and Terms of Use.

Winners may not object to any free use of their surname, first name, address, photograph and testimonial for information or promotional purposes in any operation related to the Game, unless they renounce their Prize.

Article 8 - Liability

8.1. FIS Freeride World Tour by Peak Performance shall not be held liable for the impossibility of contacting the winners, nor in the event of loss, theft or damage to the Prize during shipping. FIS Freeride World Tour by Peak Performance may not be held liable for any errors in the names, addresses and/or contact details provided by the winners of the Game. Furthermore, FIS Freeride World Tour by Peak Performance declines all responsibility for any incidents that may occur during the enjoyment of the prize awarded and/or as a result of its use and/or its consequences.

8.2. The Organizer is not responsible for any costs or expenses incurred by participants in connection with their participation in the Vote. Participants are responsible for their own internet usage costs.

8.3. FIS Freeride World Tour by Peak Performance reserves the right, if circumstances so require, to shorten, extend, modify, interrupt, postpone or cancel the competition, without incurring any liability.

8.4. FIS Freeride World Tour by Peak Performance disclaims all liability in the event of any malfunction preventing access to and/or the proper conduct of the Contest. Thus, the Organizer shall not be held liable in the event that one or more participants are unable to connect to the website due to any technical fault or problem related to, but not limited to:

The use of robots or any other similar mechanical means to participate in the Game is prohibited. Violation of this rule will result in the definitive elimination of the director and/or user. The organizer may cancel all or part of the contest if it appears that fraud has occurred in any form whatsoever. FIS Freeride World Tour by Peak Performance reserves the right not to award the prize to fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts.

Article 9 - Right of exclusion

FIS Freeride World Tour by Peak Performance may, as of right and without prior notice, exclude any participant who has not complied with the Rules, and cancel any winnings to which said participant may be entitled. The participant also acknowledges the Organizer's right to remove and cancel the participation in the Game of any participant who has not complied with the applicable rules to acquire a prize. No claim will be accepted in this respect.

Article 10 - Agreement of proof

It is agreed that, except in the case of manifest error, FIS Freeride World Tour by Peak Performance may rely, in particular for the purposes of proof of any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of a nature or in computer or electronic formats or media, established, collected or stored directly or indirectly by FIS Freeride World Tour by Peak Performance, in particular in its information systems. Thus, the aforementioned elements may be produced as means of proof by FIS Freeride World Tour by Peak Performance in any amicable or contentious proceedings. They shall be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same probative force as any document drawn up, assembled or stored in writing.

Article 12 - Completeness

Should one of the clauses of the Rules become null and void due to a change in legislation, a court decision or for any other reason opposable to the parties, this will in no way affect the validity and respect of the other clauses of the Rules.

Article 13 - Applicable law

Participants unreservedly acknowledge that the mere fact of taking part in the Game makes them subject to Swiss law.
